Welcome to VicastCam ("the software")!
This User License Agreement ("this Agreement") is entered into by the licensor and the user who uses this software ("you", "user") to regulate all your downloading, installation, registration, login, and use of this software.
Clicking the "Agree" button in this software means that you voluntarily accept all the terms of this agreement; if you do not accept it, the licensor will not grant you permission to use it. Please stop using and uninstall this software immediately. Your continued use of this software constitutes your agreement and acceptance of this Agreement and subsequent revised terms.
You confirm that you are over 18 years old or have reached the legal age of majority in the jurisdiction where you are located ("adult"); minors must use this software with the express consent and full accompaniment of a legal guardian, who assumes guardianship responsibilities in accordance with the law.
Scope of application
1 Please read the entire content of this agreement carefully before using it, especially the core terms such as disclaimer, legal application and dispute resolution marked in bold. If you do not agree with any of the terms, please stop using it immediately.
2 This software is mainly intended for adults. Minors must obtain the consent of their legal guardian before using this software and use it with the guardian's accompaniment; the guardian must perform guardianship duties in accordance with the law.
3 This agreement includes platform rules such as announcements, activity rules, and site notifications published by this software. All platform rules are an integral part of this agreement and have the same legal effect as this agreement.
4 By registering, logging in, and using this software, you are deemed to have fully read, understood, and agreed to be bound by this Agreement.
5 All intellectual property rights in this software and rights not expressly granted to the user shall belong to the licensor.
The software and related services
1 This software is an auxiliary tool for live broadcast scenes, providing functions such as live streaming, virtual scene construction, AI intelligent keying, face special effects, and beautification. Specific services and functions are subject to actual product display.
2 You can only obtain the client through official channels. The risks and losses arising from using unofficial versions are borne by you.
3 To use this software, you need to prepare your own terminal equipment and network and bear the relevant Internet access and traffic charges. The complete functions need to be connected to the Internet.
4 The Licensor grants you a personal, non-commercial, non-transferable, revocable, non-exclusive right to use the Software. Adaptation, copying, dissemination, mirroring, crawling, sale, commercial use, etc. are prohibited without the prior written authorization of the licensor.
5 The licensor has the right to upgrade, adjust, suspend or terminate some/all services based on product optimization, security maintenance, compliance operations and other needs. You can choose whether to update the client; refusing to update may result in limited functionality. You have the right to uninstall this application and terminate the service at any time.
6 Rules for using paid rights
6.1 Paid services and rights are for personal use only.
6.2 It is prohibited to provide paid rights and interests to third parties in the form of gift, loan, rental, resale, batch sharing, etc.
7 Fees, Membership and Commercial Use Rules
7.1 The licensor has the right to charge fees for the software and supporting network services in accordance with the law. You are responsible for all costs incurred by using the required hardware, software, and network, and pay the corresponding service fees on time.
7.2 You shall fulfill your tax obligations in accordance with the law and bear all taxes and fees arising from the use of services; it is prohibited to use paid services in a fraudulent manner.
7.3 We may adjust the membership system or terminate membership services based on legitimate operational needs. If the account is banned/terminated due to violations, the fees paid will not be refunded.
7.4 If you need to use this software for commercial purposes, you must apply for and obtain a formal commercial use license from the licensor in advance.
7.5 It is prohibited to use this software to spread pornographic and illegal content and make profits.
Account management
1 You can register an account independently or use a legal and compliant third-party platform account to log in with authorization. Third-party accounts must complete real-name authentication and comply with platform rules. Your account number and password are kept safe by you, and you are responsible for all actions on your account.
2 According to network supervision and real-name system requirements around the world, you must provide true, accurate, and valid identity information and contact information (such as email) when registering an account. If the information is untrue or doubtful, the licensor has the right to request correction, restriction or termination of services; due to security verification requirements, some registration information cannot be modified.
3 Some basic functions can be used without logging in; full functions and paid services require registration, login and identity verification.
4 Account nicknames, avatars, profiles and other materials must not impersonate other people's names, trademarks, portraits and other legitimate rights and interests, and must not contain illegal, vulgar or misleading content. The licensor has the right to review account information and take measures such as resetting, restricting functions, and banning accounts for illegal information.
5 The account can only be used by the user and can be logged in on devices legally controlled by the user. Donating, borrowing, renting, transferring, or selling is prohibited. When it is found that the user is inconsistent with the registrant, the licensor has the right to suspend or terminate the service.
6 You are responsible for the security and confidentiality of your account, and bear full legal responsibility for all operations, published content and behaviors under your account.
7 If your account is stolen or your password is forgotten, you can retrieve it through official appeal channels.
7.1 If your account is stolen, information is leaked, or property is lost due to improper storage, loss of equipment, or proactive disclosure of your account password, you shall bear all the responsibilities.
7.2 The account retrieval service only verifies the information retained by the system and cannot determine the user's true identity. The relevant risks are borne by you. If you find an abnormality in your account, please contact official customer service immediately.
8 Account cancellation and data processing
8.1 You can apply to cancel your account through the software "My - Settings - Account Management - Cancel Account" or the official email. Ownership verification must be completed before cancellation.
8.2 After the account is cancelled, the licensor will delete or anonymize your personal data in accordance with the law; unless it is required to be retained by laws and regulations.
8.3 After the account is canceled, the account and data cannot be recovered; your obligations and responsibilities incurred during use will not be waived by cancellation.
User Code of Conduct
1 You promise to abide by laws related to global network security, intellectual property rights, portrait rights, and privacy rights while using this software, and respect the legitimate rights and interests of others. The following actions are prohibited without legal permission or written authorization from the licensor:
1.1 It is prohibited to upload or disseminate unauthorized personal information, trade secrets, and infringing content.
1.2 It is prohibited to use plug-ins, plug-ins, and third-party tools to interfere with or destroy the normal operation of this software.
1.3 It is prohibited to carry out illegal network intrusions, steal data, spread viruses, scan for vulnerabilities, forge network data packets and other network attacks.
1.4 It is prohibited to maliciously register accounts in batches.
1.5 It is prohibited to reverse engineer, decompile, disassemble, or attempt to crack the source code of this software.
1.6 It is prohibited to produce or disseminate pornographic, violent, defamatory, and illegal content.
1.7 Promoting tobacco, alcohol, gambling, weapons, and prohibited items is prohibited.
1.8 It is prohibited to secretly photograph, secretly record, record without authorization, disseminate other people's images, sounds, private information, and infringe on other people's portrait rights and privacy rights.
1.9 Other behaviors that violate local laws, this Agreement and platform rules are prohibited.
1.10 In case of violation of this agreement, the licensor has the right to delete the illegal content without notice, and impose penalties such as warnings, function bans, equipment bans, permanent account bans, etc. depending on the circumstances; violating users can submit complaints through the official email, and the licensor has the final right to review.
2 When you use this software to create content, you are prohibited from using the software's built-in materials, special effects, and logos for third-party trademarks, logos, and commercial logos (except for your own copyrighted content).
3 You may not use this software to publish or disseminate violence, pornography, insults and defamations, human flesh searches, invasion of other people's privacy, spam advertisements, and other content that violates laws, regulations, public order and good morals.
4 The licensor has the right to supervise and review user behavior, and may require rectification, content deletion, suspension or termination of services if violations are found.
5 Special function constraints
5.1 Camera and live broadcast: Before using the camera, live broadcast, and screen recording functions, you must obtain the explicit consent of all persons being photographed and recorded. It is strictly prohibited to use this software to carry out illegal activities such as secret photography, secret recording, illegal live broadcast, etc. The relevant responsibilities shall be borne by you.
5.2 AI function: The intellectual property rights of the AI algorithm, model, special effects, and visual materials of this software are owned by the licensor or the cooperative third party. You can only use it for personal non-commercial legal creation, and it is prohibited to create deep fakes, false audio and video, fraud and illegal content.
5.3 Regional compliance: You must strictly abide by the regulatory regulations of your country/region regarding live broadcast, portrait collection, and AI content.
6 If you cause losses to the licensor due to illegal use, the fees paid will not be refunded, and you must fully compensate the licensor for all economic and goodwill losses.
Personal information protection
1 We process your personal information in strict compliance with the EU GDPR, the UK Data Protection Law, the Personal Data (Privacy) Ordinance of Hong Kong, China and data protection regulations around the world.
2 You agree that the Licensor collects, uses and stores personal information in accordance with this Agreement and the Privacy Policy. The "Privacy Policy" and this Agreement have the same legal effect.
3 We use security technologies such as encryption and anonymization to protect your personal information and prevent information leakage, tampering, and illegal access.
4 We will not share your personal information with third parties without your explicit consent, except in the following circumstances:
(1) You disclose it to a third party yourself;
(2) Based on national security, public safety, public health and statutory judicial and administrative requirements;
(3) To protect the major legitimate rights and interests of the software, other users and third parties, and comply with legal regulations;
(4) Information obtained from legal public channels;
(5) Other situations stipulated in laws and regulations.
5 You have the rights to query, correct, delete, and withdraw authorization for personal information in accordance with the law. For detailed rules on personal information, please refer to the "Privacy Policy".
Complaints and Reports
1 You can report illegal content and complain about infringement through the client or official contact email.
2 When you encounter rights infringement, you can submit proof of rights materials to initiate a complaint, and the respondent can submit an appeal for proof of ownership.
3 We usually complete the verification and feedback the results within 15 working days. Complex cases will be processed simultaneously.
Breach handling
1 If you violate this Agreement, platform rules and local laws and regulations, the licensor may take measures such as warnings, restricting functions, deleting content, suspending services, permanently banning accounts, etc. The resulting losses will be borne by you, and deleted content and data will not be restored.
2 If suspected illegal or criminal behavior is discovered, the licensor will retain evidence and report it to law enforcement agencies and cooperate with investigations.
3 If your violation causes the licensor to be subject to third-party claims, administrative penalties, or cause goodwill or economic losses, you will be responsible for all the licensor's losses.
Intellectual property rights
1 The intellectual property rights of the software code, interface, text, pictures, audio and video, special effects, trademarks, logos and other contents belong to the licensor.
2 The licensor has all rights to the legal data and information generated during the operation of the product.
3 It is prohibited to use, copy, imitate, or register "VicastCam" related brands, trademarks, domain names, logos, etc. without the express written authorization of the licensor; if illegal use causes losses, you shall bear all legal responsibilities.
4 This software contains software components distributed based on open source licenses and third-party license agreements. You must strictly abide by the corresponding license terms when using such components.
Terms of Use for Minors
1 Minors who use this software must obtain the explicit consent of their legal guardian in advance and use it under the supervision of their legal guardian. Guardians have the right to apply to restrict or cancel minor user accounts.
2 The licensor carefully collects personal information of minor users, and guardians need to guide minors to protect personal privacy and network security.
3 Guardians should perform guardianship duties in accordance with the law, guide minors to use the Internet healthily, and prevent addiction to the Internet.
4 Minors and guardians are legally responsible for all minors’ use and consequences.
5 Minors are not allowed to use cameras alone to live broadcast or appear on camera, and are not allowed to publish illegal or vulgar content.
6 If the licensor discovers that minors are using the service without the consent of their guardian, they have the right to directly restrict or ban the corresponding account.
7 Guardians should keep the payment account number and password properly to prevent minors from deducting fees without permission; if you have any questions, please contact the official customer service.
Disclaimer
1 You expressly acknowledge and agree that use of the Application is at your own risk. To the maximum extent permitted by applicable law, the Application and any services performed or provided by the Application are provided "as is" and "as available" and with all faults and without warranties of any kind, and the Licensor hereby disclaims all warranties and conditions with respect to the Application and any services, whether express, implied or statutory, including, without limitation, implied warranties and/or conditions of merchantability, satisfactory quality, fitness for a particular purpose, accuracy, quiet enjoyment and non-infringement of third party rights. No oral or written information or advice given by Licensor or its authorized representative shall create a warranty. SHOULD THE APPLICATION OR THE SERVICE PROVE DEFECTIVE, YOU ASSUME THE ENTIRE COST OF ALL NECESSARY SERVICING, REPAIR OR CORRECTION. Some jurisdictions do not allow the exclusion of implied warranties or limitations on applicable statutory rights of a consumer, so the above exclusions and limitations may not apply to you.
2 The licensor will adopt industry standard security technologies to ensure the stable operation of the service. If the service is interrupted or data is temporarily abnormal due to force majeure, natural disasters, war, government bans, network failures, system maintenance, hacker attacks, viruses, third-party service failures, equipment abnormalities and other factors beyond the control of the licensor, the licensor will not be liable for relevant compensation to the extent permitted by laws and regulations.
3 If the service is suspended or terminated due to system maintenance, version upgrade, compliance rectification, or business adjustment, we will make reasonable advance announcements through in-app announcements and official website.
4 If your equipment is damaged or data is lost due to your own operating errors, equipment failure, network setting errors, or illegal use of this software, you will be responsible for all losses.
5 We have the right to adjust service functions, modify service content or clean server data based on legal operations, system security, compliance rectification and other reasons, and will not delete user data without reason.
6 Limitation of Liability
To the extent not prohibited by law, in no event shall Licensor be liable for personal injury or any incidental, special, indirect, or consequential damages, including without limitation lost profits, lost data, business interruption, or any other commercial damages or losses, arising out of or in connection with your use of or inability to use the Licensed Application, regardless of theory of liability (contract, tort, or otherwise), even if Licensor has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury or incidental or consequential damages, so this limitation may not apply to you.
EXCEPT AS MANDATORY BY LOCAL LAW WITH RESPECT TO PERSONAL INJURY, Licensor’s TOTAL LIABILITY TO YOU FOR ALL DAMAGES SHALL NOT EXCEED ONE DOLLARS (USD 1.00). The above limitations will apply even if the above remedies fail of their essential purpose.
For jurisdictions such as the European Union, European Economic Area, and the United Kingdom, this limitation of liability clause will be strictly applied in accordance with local consumer protection laws.
Other terms
1 Applicable law
This Agreement and your relationship with Licensor shall be governed by the laws of the Hong Kong Special Administrative Region of the People's Republic of China, excluding conflict of law provisions. The United Nations Convention on the International Sale of Goods does not apply to this Agreement.
2 Dispute Resolution
For disputes arising from this Agreement, both parties will give priority to friendly negotiation; if negotiation fails, you and the licensor agree to submit it to a court with jurisdiction in the Hong Kong Special Administrative Region of the People's Republic of China.
3 Agreement Amendment
The licensor has the right to revise this Agreement during product testing and official operation, and make it public through in-product announcements, official websites and other reasonable means. After the revised terms are released, they will become an effective part of this agreement and have the same legal effect.
4 Subject relationship
You and the licensor are independent civil entities, and this Agreement does not constitute any legal relationship such as agency, partnership, employment, joint venture, joint venture, etc.
5 Effectiveness and Termination of Agreement
This agreement takes effect from the date you agree to the terms and register an account; the agreement will be terminated when the licensor terminates the service or you lose your right to use it. After the agreement is terminated, your obligations and responsibilities during its existence will still be valid.
6 Title effect
The titles of each section of this agreement are for reading convenience only and do not affect the interpretation and application of the terms.
7 Copyright and Rights Statement
The copyright of the text of this agreement belongs to the licensor. The licensor has the right to amend the agreement in accordance with laws, regulations and business needs, and enjoys the right of legal interpretation.
